Collaborator Application Terms & Conditions

These Terms & Conditions (“Terms”) apply to all individuals and businesses (“you,” the “Collaborator”) who submit a Collaborator Application to Big Daddy Fishing Rod Racks, LLC, doing business as Big Daddy Life (“Big Daddy Life,” “we,” “us,” or “our”).
By submitting your application, you acknowledge that you have read, understood, and agreed to these Terms.

1. Eligibility Requirements

• You must be at least 18 years old.

• You must be based in the United States.

• All applicants—including businesses—must have active, public-facing social media platforms that align with their stated interests and reach.

• Businesses must also provide a verifiable website or online presence.
   

2. Application Process & Review

• Submitting an application does not guarantee acceptance.

• Big Daddy Life reserves the right to approve or deny applicants at our sole discretion.

• You may be asked to provide additional materials, such as analytics, case studies, or content samples.

• We review for authenticity, brand alignment, platform activity, and content quality.
   

3. Representation

• You must accurately identify yourself as a business, influencer, or other.

• Misrepresenting your identity, platform size, or metrics will result in disqualification or removal from the program.
   

4. Types of Collaborations
You may express interest in one or more of the following collaboration types:

• Giveaways or contests

• Collaborative content creation

• Affiliate partnerships

• Influencer takeovers

• Shoutouts or mentions

• Content series or challenges

• Events or webinars

• Cross-promotions

• Collaborative series

• Other custom projects
   

Platform & Promotion Guidelines
Any collaboration involving a giveaway, contest, takeover, or promotion must comply with:

• The specific platform’s terms of service (e.g., Instagram, TikTok, Facebook, YouTube)

• Applicable federal and state promotional laws

• Big Daddy Life’s brand standards

You are expected to:

• Clearly disclose rules, eligibility, deadlines, and how winners are selected

• Include a disclaimer if the promotion is not affiliated with or sponsored by the platform

• Avoid unethical tactics like fake tagging, comment baiting, or misrepresentation

• Maintain professionalism, accuracy, and transparency in all promotional material
  Big Daddy Life reserves the right to review, require edits to, or reject any proposed promotional campaign that does not meet legal or brand expectations.

5. Content Ownership & Usage Rights

• All content created for or on behalf of Big Daddy Life may be used across our digital and print platforms, including but not limited to our website, social media, email marketing, and advertisements.

• You grant Big Daddy Life a non-exclusive, royalty-free, perpetual, worldwide license to use, adapt, and distribute submitted content.

• Tagging and crediting may be used but are not guaranteed.
   

6. Disclosure & Compliance

• You must follow FTC guidelines by disclosing all sponsored content appropriately (e.g., using hashtags such as #ad, #sponsored, #gifted).

• You must comply with all policies of the platforms where content is posted.

• Failure to disclose relationships or use deceptive tactics may result in immediate termination.
   

7. Compensation

• Compensation may include payment, products, affiliate commissions, or promotional codes.

• All agreed deliverables must be completed and approved before compensation is provided.

• You may not use affiliate or promo codes for your own purchases unless explicitly approved.
   

8. Contracts & Legal Obligations

• If you enter into a formal agreement or contract with Big Daddy Life, it is legally binding.

• Failure to meet the terms of a signed contract may result in:

  • Termination of the relationship

  • Loss of unpaid compensation, affiliate access, or other perks

  • Legal action, including potential lawsuits for breach of contract and damages

• All parties are expected to act in good faith and uphold professional conduct.
   

9. Confidentiality
Any non-public information you receive from Big Daddy Life, including upcoming product releases, pricing, internal strategy, or campaign details, is confidential. You may not disclose this information without written consent.

10. Termination
Big Daddy Life may terminate a collaboration at any time, with or without cause.
Common reasons for termination include:

• Breach of these Terms or a signed contract

• Unethical or unprofessional behavior

• Misuse of brand materials or intellectual property

• Poor content quality or lack of responsiveness

You may withdraw by providing written notice, but any agreed-upon deliverables must still be fulfilled unless officially released in writing.

11. Limitation of Liability
Big Daddy Life is not responsible for indirect or incidental damages arising from your participation. We make no guarantees of financial results or social growth.

12. Governing Law
These Terms are governed by the laws of the State of New Jersey. Any legal disputes must be resolved in a court of competent jurisdiction located in New Jersey.
